Article 1. Applicability
1.0 You can only place an order on this site if you are over 16 years old.
1.1 These General Terms and Conditions apply to all offers, orders, and agreements of Qualiserv Plus BV.
1.2 Accepting an offer or placing an order implies that you accept the applicability of these conditions.
1.3 Deviations from these Conditions can only be made in writing, in which case the remaining provisions remain fully in force.
1.4 All rights and claims, as stipulated in these Conditions and in any further agreements on behalf of Qualiserv Plus BV, are also stipulated on behalf of intermediaries and other third parties engaged by Qualiserv Plus BV.
Article 2. Offers/Agreements
2.1 All offers from Qualiserv Plus BV are without obligation and Qualiserv Plus BV expressly reserves the right to change prices, particularly when this is necessary due to (legal) regulations.
2.2 An agreement is only concluded after acceptance of your order by Qualiserv Plus BV. Qualiserv Plus BV is entitled to refuse orders or to attach certain conditions to the delivery, unless explicitly stated otherwise. If an order is not accepted, Qualiserv Plus BV will inform you within ten (10) working days after receiving the order.
2.3 The color seen on the published photos of the products may slightly differ from the actual color.
2.4 Most products, namely the chromolithographs and lithographs, are second-hand. This means that traces of use and/or wear may be present on the sold items. To inform you sufficiently, a photo has been taken of each product. These photos are part of the product description and are deemed to have been carefully examined by the buyer. The seller will refuse returns for defects that are clearly visible on the photos associated with the product. In case of any ambiguity or additional questions, you can request the necessary extra information via the contact form.
2.5 For the chromolithographs of certain brands (e.g., Liebig), you will see a rating ranging from excellent to good. This is a personal interpretation, made to the best of our ability. The photos associated with the product can help you determine the quality of the items.
Article 3. Prices and Payments
3.1 The prices listed for the offered products are in Euros, including VAT, when applicable. The goods are subject to the Belgian VAT regime which is paid in Belgium (resale).
3.2 Payment must be made online unless otherwise agreed in writing. The goods will only be shipped once the payment has been verified and approved by the independent payment provider of Qualiserv Plus BV. Qualiserv Plus BV reserves the right to refuse orders without giving reasons.
3.3 If the prices for the offered products and services increase in the period between the order and its execution, you are entitled to cancel the order or to dissolve the agreement within ten (10) days after notification of the price increase by Qualiserv Plus BV.
Article 4. Delivery
4.1 The delivery times provided by Qualiserv Plus BV are only indicative. Exceeding any delivery term does not entitle you to compensation and does not give you the right to cancel your order or dissolve the agreement, unless the delivery term is exceeded to such an extent that you cannot reasonably be expected to maintain the agreement. In that case, you are entitled to cancel the order or dissolve the agreement to the extent necessary.
4.2 The delivery of the products takes place at the place and time when the products are ready for shipment to you.
Article 5. Retention of Title
5.1 The ownership of delivered products only transfers to you if you have fulfilled all your obligations under any agreement with Qualiserv Plus BV. The risk regarding the products transfers to you at the time of delivery.
Article 6. Intellectual and Industrial Property Rights
6.1 You must fully and unconditionally respect all intellectual and industrial property rights resting on the products delivered by Qualiserv Plus BV.
6.2 Qualiserv Plus BV does not guarantee that the products delivered to you do not infringe any (unwritten) intellectual and/or industrial property rights of third parties.
Article 7. Complaints and Liability
7.1 You are obliged to examine whether the products comply with the agreement upon delivery. If this is not the case, you must inform Qualiserv Plus BV as soon as possible and in any case within two working days after delivery, or as soon as the observation was reasonably possible, in writing/email and with reasons.
7.2 If it has been demonstrated that the products do not comply with the agreement, Qualiserv Plus BV has the choice to replace the relevant products upon return or to refund the invoice value.
7.3 If you do not wish to accept a product for any reason, you have the right as a consumer to return the product to Qualiserv Plus BV within 14 working days after delivery. Returns will only be accepted if the packaging of the product and the product are undamaged, and the costs for returns are borne by you.
Article 8. Warranty
8.1 If Qualiserv Plus BV supplies products to the buyer, Qualiserv Plus BV is never obliged to provide a further warranty to the buyer than that which Qualiserv Plus BV can claim against its supplier.
Complaints about visible defects must be submitted in writing in accordance with the contract conditions, but no later than 14 days after receipt of the goods by the client. For Consumers, a period of 14 (fourteen) days applies. Complaints received by Qualiserv Plus BV after the expiry of this period do not need to be handled by Qualiserv Plus BV. The money will be refunded within 14 days after receipt of the returned goods.
Article 9. Orders/Communication
9.1 Qualiserv Plus BV is not liable for misunderstandings, mutilations, delays, or improper transmission of orders and communications resulting from the use of the Internet or any other means of communication between you and Qualiserv Plus BV, or between Qualiserv Plus BV and third parties, insofar as they relate to the relationship between you and Qualiserv Plus BV, unless and insofar as there is intent or gross negligence on the part of Qualiserv Plus BV.
Article 10. Force Majeure
10.1 Without prejudice to its other rights, in the event of force majeure, Qualiserv Plus BV has the right, at its discretion, to suspend the execution of your order or to dissolve the agreement without judicial intervention, by informing you in writing and without Qualiserv Plus BV being liable for any compensation, unless this is unacceptable according to standards of reasonableness and fairness in the given circumstances.
10.2 Force majeure means any shortcoming that cannot be attributed to Qualiserv Plus BV because it is not its fault and cannot be attributed to it by law, legal act, or generally accepted practice.
Article 11. Miscellaneous
11.1 If you provide Qualiserv Plus BV with an address in writing, Qualiserv Plus BV is entitled to send all orders to that address, unless you provide Qualiserv Plus BV with written notice of another address to which your orders should be sent.
11.2 When Qualiserv Plus BV tacitly or explicitly allows deviations from these Conditions for a short or long period, this does not affect its right to demand immediate and strict compliance with these Conditions. You can never assert any rights based on the fact that Qualiserv Plus BV applies these Conditions smoothly.
11.3 If one or more of the provisions of these Conditions or any other agreement with Qualiserv Plus BV are in conflict with any applicable legal provision, the relevant provision will lapse and be replaced by a new legally permissible comparable provision to be determined by Qualiserv Plus BV.
11.4 Qualiserv Plus BV is authorized to use third parties in the execution of your order(s).
11.5 Qualiserv Plus BV owns all the photos used on this site. Their use is only permitted with the explicit written permission of Qualiserv Plus BV.
Article 12. Applicable Law and Competent Court
12.1 All rights, obligations, offers, orders, and agreements to which these Terms and Conditions apply, as well as these Terms and Conditions, are exclusively governed by Belgian law.
12.2 All disputes between parties will be exclusively submitted to the competent court in Mechelen.
